Michigan Joins Lawsuit Against Federal Education Restrictions

LANSING, MI — Michigan has joined 19 other states in a significant legal battle against federal education authorities, filing a lawsuit on April 25 over perceived threats to withdraw funding in response to diversity, equity, and inclusion (DEI) initiatives in schools. Spearheaded by Attorney General Dana Nessel, the coalition’s action targets the U.S. Department of Education, Secretary Linda McMahon, and Assistant Secretary Craig Trainor.

The lawsuit follows an April 3 directive from the Department of Education, demanding that state and local education agencies sign a document affirming compliance with the Trump administration’s interpretation of Title VI of the Civil Rights Act of 1964. This interpretation may jeopardize federal funding for schools that continue DEI programs, perceived by the federal government as a form of discrimination.

“It’s appalling that the federal government would compromise our schools to advance political agendas,” Nessel remarked in a press release, highlighting the untenable position for educators: either to risk funding loss or certify compliance with regulations that compromise educational integrity.

Michigan’s education system heavily relies on federal funding, with nearly $1.27 billion allocated for Fiscal Year 2024, supporting special education and programs for low-income and foster care students. Nessel emphasized that Michigan has consistently complied with Title VI, arguing the federal demands contradict federal law.

The coalition’s lawsuit seeks to prevent the Department of Education from withholding funds, asserting that the attempt contravenes multiple federal regulations. The legal push aligns with recent federal court rulings suggesting that the administration’s DEI policies may violate legal standards. This litigation marks another chapter in Nessel’s ongoing legal efforts against the Trump administration, addressing various contentious issues since its inception.
