FDA Delays Posting Food Safety Warning Letters Due to Staff Reductions


A seafood company, a dietary supplement vendor, and a fresh sprouts producer have been flagged by the FDA for significant violations of federal food safety rules, including failure to prevent potential botulism contamination and misleading health claims. These findings were detailed in warning letters; however, the public remains unaware of these issues due to a halt in the publication of such letters. This delay followed the mass layoffs of FDA staff in early April under the Trump administration, which impacted the teams responsible for reviewing and redacting the letters before they are posted online.

The FDA maintains that it is committed to transparency and public health; however, the agency has not addressed the backlog in publishing food safety warning letters. Typically, after inspections, if a company’s response to concerns is deemed inadequate, the FDA issues a warning letter and allows a few weeks for the company to respond before making the letter public. These letters serve as an essential enforcement tool, as they alert the public and retailers about serious food safety violations.

Safety advocates emphasize that these letters indicate serious issues and are crucial for public awareness. An example highlighted is a warning letter sent to Dollar Tree for not recalling lead-tainted applesauce. Recently, some FDA staff involved in public records have been rehired, and the agency continues to issue letters related to drugs and tobacco, but food safety letters have not been updated since January 21, when unsanitary conditions in a Utah bread factory were documented, prompting the company to improve its food safety practices. The concern remains that the lack of transparency poses risks to public health.
