The lawsuit, filed against 13 CPS workers, alleges gross negligence and a failure to protect Chayce from repeated abuse by his mother, Azuradee France.

Chayce and his siblings were initially removed from France’s care in December 2018 due to allegations of abuse and alarming living conditions. However, after two years in foster care, they were returned to her in November 2020, despite ongoing concerns about her stability. Just months later, Chayce suffered severe injuries, including burns, a black eye, and malnourishment. Medical professionals recommended further investigation into suspected abuse—warnings that were reportedly ignored by CPS.

Court documents reveal that CPS workers conducted interviews in front of Chayce’s mother, gave her advanced notice of home visits, and closed an abuse investigation mere days after he was hospitalized. Just months before his death, the signs of his suffering were evident, yet protective actions were not taken in time.

Chayce’s tragic fate has ignited outrage, with the Michigan House Oversight Subcommittee hearing testimonies about CPS failures. Allen is seeking over $75,000 in damages, plus punitive costs, highlighting systemic issues within the child welfare system. While the Michigan Department of Health and Human Services reportedly declined to comment on the ongoing litigation, they reiterated their commitment to child safety.

France, who pleaded guilty to second-degree murder in July 2024, currently faces a 35 to 60-year prison sentence. The lawsuit seeks accountability for the apparent lapses in CPS protocol that contributed to Chayce’s demise, underscoring a critical need for reform and vigilance in child protection practices.
